Infringment Policy

Please read this policy carefully.

This Cloud Tutor 360 rights infringement policy is a documentation of procedures concerning claims to property rights infringement by third parties on our official website. This policy is subject to modification by us. And we will notify users of any update to the procedures. We, hereby, advice all Cloud Tutor360 users to consult the infringement policy regularly for any updates.

If you own the sole right to a property and believe that a Cloud Tutor 360 user is infringing on that right, kindly forward a written statement to our legal support team via email. You may also forward a printed copy of the statement, addressed to our legal support team, to our office address.

Note: the statement is in fulfilment of United States Digital Millennium Copyright Act, 17 U.S.C. Section 512(c)(3) ("DMCA").

Cloud Tutor 360 may respond to your written statement by removing or disabling access to the material that is allegedly infringing, or take any other action we deem appropriate, discretely. Please, note that you may be liable for any cost, damage, or attorney’s fees if your infringement claim is invalid or misrepresented. Cloud Tutor 360 may attempt to contact the user responsible for posting the infringement material to provide a counter statement.

The written statement must include the following numbered items:

  • Highlight the particular property right that you claim is infringed, and attach a link to the original location of the material. For example, highlight your trademark or quote your copyrighted material.
  • Highlight the website, webpage, post, profile, feedback, or other material that you claim infringes your proprietary rights, with sufficient information to enable us to locate it.
  • Give us your name, address, phone number, and email.
  • If possible, give us the contact details of the administrator of the alleged infringing material.
  • Include the following statement;
    • “I know, with confidence, that the material used as described is not authorized by the owner of the exclusive proprietary right, its agent, or the law.”
    • “All information in this statement is accurate.”
    • “Under penalty of perjury, I swear that I am authorized to take action on behalf of the owner of the exclusive proprietary right that is allegedly infringed.”

Append your signature, and date the statement.

As the owner of the alleged infringing material, you may provide us with a counter statement via email or by postal mail to our legal support team.

Note: the counter statement is in fulfilment with the requirements of the United States Digital Millennium Copyright Act, 17 USC Section 512(g)(3).

Cloud Tutor 360 may respond to your written statement by restoring access to the material that is allegedly infringing. Please, note that you may be liable for any cost, damage, or attorney’s fees if the material is infringing to the property rights of others.

The written counter statement must include the following numbered items:

  • Highlight the website, webpage, post, profile, feedback, or other material that we have removed or disabled. Identify the initial location of the removed or disabled material.
  • Give us your name, phone number, contact email, and address.
  • Include the following statement:
    • “that you agree to comply with the jurisdiction of the Federal Court in your judicial district, and that you accept process service from whoever provided the notice, whether a person or an agency.”
    • “Under penalty of perjury, I swear that I believe the removed or disabled was due to a mistake or misidentification.”

Append your signature, and date the statement.

Note: Cloud Tutor 360 cannot give you legal advice. Please, do well to contact an attorney to find out if certain proprietary rights are valid or if a material is infringing.
